A criminal offence can arise from a failure to comply with legal duties imposed by the Health and Safety at Work etc. Act 1974 (HSWA) and regulations made under it. This Act applies in England, Wales and Scotland.
In Northern Ireland, the equivalent legislation is the Health and Safety at Work (Northern Ireland) Order 1978 (subordinate regulations are adopted as in Great Britain).
In the Republic of Ireland, the equivalent legislation is the Safety, Health and Welfare at Work Act 2005, and the main subordinate regulations are the Safety, Health and Welfare at Work (General Application) Regulations 2007. In the Isle of Man, the Health and Safety at Work Etc Act 1977 is in place. This is the means by which the UK 1974 Act has been adapted and applied to the Island.
